• 0: I will not upload to those who break the VRChat TOS or the VRChat Community guidelines (hello.vrchat.com/community-guidelines). A refund will be issued.

​

• 1: DO NOT USE THIS OR ANY OF MY MODELS, ART, OR IMAGES OF MY WORK FOR AI, whether putting it into AI generation / AI scrapers, or using it as a representation for AI chatbots. This includes using imagery of them for the above mentioned.

​

• 2: You must have a discord to contact me though, or a trusted person to contact me on your behalf though discord.

​

• 3: You must be above visitor rank (New user and above); this is because it will not let me upload to the account if it's a visitor or below.

​

• 4: You must have a real VRC account that is linked to an email (or again, VRChat will not let me upload it to you).

​

​

• 5: I'm selling uploads to the avatar and the right to use it, and not files. This is for preventing file sharing and my own safety of my work.

​

• 6: You are free to use the avatar (once bought) for videos, streams, commercial use, representation of yourself e.t.c. As long as credit is given (Linking to me or the store would be great, but at the very least put "Ink model used by: Duskstar Shine" ).

• 7: DO NOT PUBLICLY USE/DISCUSS USING FOR NSFW PURPOSES. My works are made for 13+, and thus I would like to keep public discussion and view within that to avoid children coming across NSFW things of my work.

​

• 8: I have the full right to remove ownership of the right to own the avatar if my TOS has been majorly violated. Buying it you are agreeing to abide by the TOS, so if it's broken, you have broken the "deal" in which the avatar was bough through, meaning your right to have the avatar on your account will be revoked, I'll contact you if this happens. See TOS: 15.

• 9: DO NOT EVER public the uploaded avatar, it is to always remain private after the upload.

​

• 10: I do what I can to keep accounts safe on my end, so any private information such as emails, passwords, accounts and such are the buyers responsibility if something happens to them.

​

• 11: DO NOT perform or participate illegal activities in my avatars/using my work.

​

• 12: Do not change the avatar thumbnail or description! (if you feel you need to for some reason such as a name change, INFORM ME on discord and I'll do what I can <3 ).

​

• 13: I have the right to change/update the TOS within reason at any time if I feel something isn't right.

​

• 14: Any way of gaining an upload by unauthorized means without paying, you will be blacklisted, reported, and will be strongly prompted to my work down, this includes ripping, fake receipts, bought then refunded, or TOS breaking. If not compliant, a DMCA will be issued.

​

• 15: This TOS still applies to any upload, whether it was bought here, gifted by someone, or won in a raffle!

​

• 16: The avatar is sold as is, and may get updates/fixes over time that you may not have gotten when you got it first uploaded. See "Account transfer or update to avatar" section for info. (Fees may apply if wanting an update).

• 17: My models are often made and owned by me, however the character may not owned by me, see the credits section on each store to see credits and links to the character's owners. Please be mindful the character's own TOS as set by their owner if they have one.
